Alabama Medical Marijuana Update: Patient Registry Will Be Established

Nearly four years after the passage of Alabama’s medical marijuana law, patients are still unable to access treatment legally. However, a long-awaited breakthrough could be on the horizon. A legal challenge filed by a group of Alabama parents has brought new urgency to the process and may finally lead to the launch of the state’s official patient registry.


The patient registry is a required step under the Darren Wesley “Ato” Hall Compassion Act, the 2021 law that legalized medical marijuana in Alabama. Without it, patients cannot register, physicians cannot certify, and dispensaries cannot serve the public.


Why the Registry Matters

The patient registry is the gateway to legal medical marijuana access in Alabama. It’s how eligible patients and caregivers officially enroll in the state program and receive the ID cards required to purchase medical marijuana products from licensed dispensaries. Until the registry is live, no part of the system can fully function.


The Alabama Medical Cannabis Commission (AMCC) was legally required to create this registry by September 1, 2022. However, delays in the licensing process and regulatory issues have stalled the program. Currently, Alabama patients still have no legal access to medical marijuana, despite the law being on the books for years.


The Lawsuit from Alabama Families

Frustrated by the lack of progress, five Alabama parents filed a lawsuit earlier this year. Each parent has a child with a qualifying condition under the Compassion Act. The suit asks the court to compel the Alabama Medical Cannabis Commission to activate the patient registry immediately, regardless of whether other parts of the industry are fully operational.


The Commission argues that while the registry platform exists, it is not accepting patients because physicians cannot yet be certified, and until patients can be certified by a licensed marijuana doctor, the registry cannot technically function. But the lawsuit claims this interpretation violates the original law, which required the registry to be ready and operational by late 2022.


A judge in Montgomery County is scheduled to hear the case on June 26, 2025. Depending on the outcome, the ruling could force the Alabama Medical Cannabis Commission to move forward immediately. We'll keep you updated on our website blogs with all the latest information and how the case goes
