Alabama’s medical marijuana program has been a long time in the making. Patients and advocates have waited patiently for years since the state legalized medical marijuana in 2021 under the Darren Wesley “Ato” Hall Compassion Act. As of now, dispensaries remain unopened, the patient registry is not yet active, and legal access for qualifying patients has not begun.
Here’s where things stand today, and why Alabama’s top medical marijuana official is hopeful that patients could finally gain access by the end of 2025.
Where the Alabama Medical Marijuana Program Stands
Since the Compassion Act was signed into law, Alabama has been working through the necessary steps to establish a regulated program. The law allows registered patients with qualifying medical conditions to legally purchase and use approved forms of medical marijuana, including capsules, tinctures, gels, patches, oils, and other non-smokable products.
The Alabama Medical Cannabis Commission (AMCC) began issuing grower, processor, and dispensary licenses in 2023. Unfortunately, lawsuits and legal challenges regarding the fairness and transparency of the licensing process led to several rounds of halted and reissued licenses.
In early 2025, the Alabama Court of Civil Appeals cleared the way for the Medical Cannabis Commission to resume licensing, lifting a temporary restraining order and allowing administrative hearings for dispensary license applicants to move forward. While this was a major milestone, the program still faces delays in establishing the patient registry and resolving ongoing lawsuits brought by license applicants and patients.
At this time, the patient registry remains inactive, preventing patients from applying for medical marijuana cards. However, hearings this past June signaled growing pressure on the state to move forward with patient registration and dispensary openings.
If all goes as planned, some dispensaries could begin operations by the end of 2025, with full legal access expected to follow shortly after.
Why Alabama’s Top Medical Marijuana Official Is Hopeful
In a recent interview, Alabama Medical Cannabis Commission director John McMillan expressed optimism that Alabama patients may finally have legal access to medical marijuana by the end of 2025. McMillan described the current timeline as the “best-case scenario,” acknowledging the significant hurdles the program has faced over the past several years.
McMillan’s hope stems from recent legal victories for the Alabama Medical Cannabis Commission, progress on license hearings, and growing political and public pressure to fulfill the state’s commitment to patients. While he cautioned that ongoing lawsuits and administrative challenges could still create delays, he made it clear that the commission is working diligently to meet this timeline and deliver on the promise of medical marijuana access in Alabama.
