Alabama Judge Keeps Medical Marijuana Licensing on Hold


Alabama's journey to establish a medical marijuana program has faced another hurdle. Montgomery County Circuit Judge James Anderson has extended a temporary restraining order on the issuance of medical marijuana business licenses, delaying the launch of the market once again. This decision has brought both frustration and determination among stakeholders eager to see the program come to fruition.


The Background of Alabama's Medical Marijuana Program

The Alabama Legislature approved a medical marijuana program in 2021, known as the Alabama Compassionate Act. This law allows patients certified by participating physicians to use medical marijuana for 15 conditions, including cancer, chronic pain, depression, and Parkinson's Disease. The program is still under development and has yet to begin registering patients or caregivers.


Initially, the Alabama Medical Cannabis Commission (AMCC) was set to start accepting business applications on September 1, 2022. Despite this planned start, various legal challenges have prevented the issuance of licenses, keeping the program in a state of limbo.


Legal Challenges and Delays

The most recent delay comes from Judge Anderson's decision to extend the temporary restraining order. This extension was pushed by Alabama Always, a medical marijuana company seeking one of the state’s vertically integrated licenses. The restraining order aims to address concerns raised by companies that were denied licenses in previous rounds.


Last December, Alabama regulators issued five integrated licenses to medical marijuana companies, including Flowerwood Medical Cannabis, Specialty Medical Products of Alabama, Sustainable Alabama, Trulieve AL, and Wagon Trail Med-Serv. The application and selection process for these licenses sparked lawsuits, leading to multiple rounds of legal battles and further delays.


Judge Anderson's Ruling

Judge Anderson's ruling includes denying the AMCC’s motion to dismiss the lawsuit and agreeing to allow a new temporary restraining order. This order requires both parties to work on its language, ensuring it allows investigative hearings to begin while preventing the issuance of licenses.


According to Anderson, “The combination of the urgency and the Commission’s failure to do their job is an exceptional condition to allow the appointment of a special master to allow the court to move the process forward. That’s the only way it could get done any time soon.”


The Role of the Alabama Administrative Procedure Act

One of the critical issues in the ongoing legal battle is whether the licensing process falls under the contested case provisions of the Alabama Administrative Procedure Act (AAPA). Somerville, attorney for Alabama Always, argues that it does, stating, “It’s simply an untenable argument that this is not a contested case.”


Counsel for the Commission maintains that the investigative hearing would provide due process, allowing plaintiffs to show why a company awarded a license should not have one issued to them. However, the defendants and Anderson questioned what relief would be available, given the limited number of licenses.


The Need for Medical Marijuana in Alabama

Alabama's delay in issuing medical marijuana licenses is particularly frustrating given the potential benefits of medical marijuana. Bills such as SB 276 and SB 306, which aimed to increase the number of licenses and restart the licensing process, stalled in the Senate and never reached a floor vote.


Despite these challenges, there is hope that the program will eventually move forward. Judge Anderson has directed the companies denied a license and the AMCC to provide a jointly proposed order that allows investigative hearings on awarded licenses to continue but prevents those licenses from being issued.


The delay in Alabama's medical marijuana program is a setback for patients in need of relief from chronic conditions. However, the legal proceedings aim to ensure a fair and transparent process for issuing licenses.
