Alabama Medical Marijuana Program Update: Licensing Progress


In a significant stride toward compassionate patient care, the Alabama Medical Cannabis Commission (AMCC) recently awarded 20 licenses for the production and distribution of medical marijuana. Integrated facilities, capable of producing medical cannabis products from seed to shelf, are slated to present their applications in the coming week, with awards expected on December 12.


The commission has the authority to award up to 12 licenses for cultivating cannabis, four for processing, and four for dispensing the product. Unlike other categories, there are no caps on licenses for secure transporters and testing labs. This diverse range of licenses reflects Alabama's commitment to fostering a well-regulated and comprehensive medical marijuana program.


Legal Hurdles and Procedural Adjustments

Alabama's journey toward establishing a robust medical marijuana program has not been without challenges. The initial awards in June faced legal scrutiny due to scoring inconsistencies in the evaluation process. Subsequent lawsuits and backlash led to the voiding of the awards, prompting the AMCC to reevaluate its approach.


A lawsuit alleging violations of the Open Meetings Act interrupted the process again in August. In response, the commission rescinded the awards for the second time, engaging in negotiations with claimants to chart a viable path forward. The culmination of legal disputes and stalled negotiations eventually led to the adoption of new licensing and application rules in October, paving the way for the latest round of applications.


Legislative Framework and Patient Access

The foundation for Alabama's medical cannabis program was laid by the state legislature's approval in 2021. However, licenses could not be issued until September 1, 2022, as stipulated by the bill authorizing the program. The AMCC commenced accepting applications late last year, initiating a meticulous process to ensure the establishment of a responsible and patient-centric medical marijuana program.


When medical marijuana becomes available, patients certified by participating physicians will have access to cannabis for 15 conditions, including cancer, chronic pain, depression, and Parkinson's disease. To obtain medical cannabis, patients must apply for a card from licensed dispensaries. The law restricts smoking or consuming marijuana-infused food, allowing its availability in various forms such as tablets, capsules, gelatins, oils, creams, and transdermal patches.
