Alabama Medical Marijuana Challenges: An Update

The AMCC has been at the center of the controversy surrounding the rollout of the medical marijuana program. The commission's attempts to issue licenses have been repeatedly challenged, leading to significant delays. Brittany Peters, a spokesperson for the AMCC, stated that the restraining order preventing dispensary licenses from being issued is a major barrier to getting products to patients. Despite these challenges, cultivators are preparing to harvest their first crops, although uncertainty remains about when these products can be sold.


Attempts to address the ongoing litigation through legislation have largely failed. For instance, HB 390, sponsored by Danny Crawford, moved licensing powers for cultivators to the AMCC. However, other bills aimed at expanding the number of licenses and reforming the licensing process, such as SB 276 and SB 306, stalled in the Senate and never reached a vote.
